They usually will not do the deal unless they are the first lien. If theyre is already a tax lien on the home, the mortgage co would be second in line to be paid back if when the house is sold, so they will treat the loan like a second mortgage even though there is no first mortgage.

Being a 2nd loan will make it alot harder to get the financing needed, and result in much higher interest rates if you obtain the refi.
